296294BR296294BRJob Description:Job PurposeTo provide privacy-related legal support and advice on US commercial, advertising, sales and marketing, data analytics, and digital privacy related matters, and develop related training and policies, guidelines and procedures for monitoring internal compliance.Key Responsibilities Include: Legal advice and support - Provide privacy-related legal support on commercial, advertising technology, sales and marketing, digital, and information technology US privacy issues, including website and mobile privacy disclosures, de-identification, data analytics/big data, data breaches, and emerging digital technologies. Support business/transactional counsel with the review and negotiation of privacy language with vendors as needed. Manage outside counsel on privacy issues as needed. Policies and Procedures - Create and implement US guidance, policies and procedures related to commercial, data analytics, and advertising/marketing privacy issues in line with the Novartis global privacy program and US privacy initiatives. Incorporate privacy-related guidelines within business processes where appropriate to support privacy by design. Risk Management - Review Novartis practices for compliance with US privacy and data protection laws, as well as company policy. Develop, adapt and implement procedures for monitoring compliance with US data protection regulations and internal policies, particularly with regard to commercial, advertising/marketing, and digital issues, in line with the Novartis global privacy framework. Conduct privacy risk assessments as needed. Partner with respective business operations to implement remediation measures as needed. Training – Develop and conduct appropriate privacy trainings for legal and business functions. Third Party Risk Management - Work with other members of the Novartis Privacy Team and Novartis risk management functions to develop, adapt and implement procedures for management of 3rd party vendors with access to Novartis’ personal information in compliance with US privacy and data protection laws and regulations. Best Practice/Knowledge Sharing – Ensure up-to-date knowledge of latest trends in US privacy. Where you’re empowered to risk failure by taking smart risks, and where you’re surrounded by people who share your determination to tackle the world’s toughest medical challenges.Imagine what you could do at Novartis!nnnnPosition Title:Director, US Data Privacy CounselMinimum requirements:Education/Experience: Juris Doctorate (J.D.) or equivalent Law Degree required. 7+ years legal counselling experience, including US privacy and data protection experience, preferably from within a major international law firm or multi-national corporation.Technical Skills/Knowledge: Strong knowledge of US digital, data analytics/big data, advertising technology, and marketing and sales privacy issues. Knowledge of the US privacy and data protection laws with a focus on FTC, CCPA, CAN-SPAM, TCPA, HIPAA and related US privacy regulations. Strong track record of identifying potential privacy risks/ issues and developing business-friendly pragmatic and sustainable solutions, particularly in relation to emerging digital technologies and trends including commercial, advertising, sales and marketing, data analytics, and other digital privacy-related matters. Demonstrated track record of drafting and implementing privacy guidelines, policies and procedures. Strong experience in designing and implementing effective training programs. Outstanding writing skills required to draft/edit privacy guidelines and assessments.Leadership/Organizational Skills: Excellent communication, interpersonal and presentation skills - Ability to adapt style to communicate at all levels of the organization. Ability to interact with and influence senior leadership across businesses and functions. Strong results orientation and drive to succeed. Demonstrated track record of collaboration/teamwork.
