Project Description:
  • Under the general supervision of the General Legal Counsel/Division of Management Administrator/Inspector General] this professional Program and Policy Analyst - Advanced Management position is responsible for administering and overseeing the Privacy Program, including policy analysis, planning, monitoring, and consultation.
  • The incumbent ensures that data is managed according to fair information practices, privacy regulations, as well as, state and federal confidentiality laws.
  • In addition, this position oversees and provides leadership on all activities related to the development, implementation, maintenance of, and adherence to the Client’s policies and procedures necessary comply with privacy rules, regulations, and laws.
  • This individual will coordinate with staff and management throughout the department on privacy-related issues and efforts that support the goals of the Privacy Program.

This position will help ensure that:

  • Maintains privacy while sharing data to improve outcomes for the client serves

Responsibilities:

Goals and Worker Activities

40% - Provide leadership and oversight of the Privacy Program
  • Facilitate the creation, analysis, coordination, planning, implementation, and evaluation of Department-wide policies and procedures that promote the mission of the Department’s Privacy Program.
  • Monitor compliance with statutory and administrative privacy policies.
  • Develop, monitor, and consult on internal and external procedures necessary to meet federal and state law regarding access to confidential information.
  • Collaborate with necessary partners and advise Department leadership on the policies and procedures necessary to meet federal and state laws on all data confidentiality and privacy.
  • Provide leadership in the development, administration, and collaboration of effective procedures for mitigating damage to the Department and/or affected individuals in the event of a privacy breach, including the facilitation of the the System Misuse Workgroup, and other related teams, committees, or workgroups.
  • Manage the development and administration of privacy-related training for all staff.
  • Represent the agency, as authorized by client, on privacy-related boards, panels, councils or any other formal or ad hoc privacy related bodies.
  • Serve as the Department contact for privacy matters and other state agencies, tribal councils, counties, municipal agencies and other public or private associations, committees, or advisory boards.
  • Evaluate the effectiveness of the Privacy Program to ensure performance standards are being met. Recommend and implement program, policy, and procedural changes.
  • Serve as Contract Administrator for privacy-related procured services (i.e. Thomson Reuters CLEAR)

40% - Provide oversight and consultation to management and staff on privacy matters and privacy policy issues.
  • Coordinate and consult with data stewards, security, and legal personnel to review and mitigate confidential information privacy and security breaches.
  • Consult with administrators, supervisors and other personnel to investigate and make determinations on breaches of confidential information.
  • Develop and maintain processes to track, investigate and report inappropriate access, acquisition and disclosure of confidential, PII or other sensitive information. Manage such incident reporting systems and periodically compile reports on incidents.
  • Review and consult on when and how the Department transports, transmits or shares information within the Department, with other state agencies and with third parties outside of state government.
  • Review contracts, data sharing agreements, create and maintain privacy policies, deal with privacy issues surrounding data sharing.
  • Develop and maintain processes to track when client transmits or received data from third parties and ensure data destruction requirements are met.

15% - Function as expert in providing policy interpretation relating to data confidentiality and privacy.
  • Collaborate with Department legal counsel and advise Department leadership on the policies and procedures necessary to meet federal and state laws on all data confidentiality and privacy.
  • Ensure that data collection, reporting, and access protect privacy rights and provide useful information.
  • Address privacy related questions, concerns and recommendations from Department leadership, managers, employees and/or other stakeholders.
  • Review new and revised state and federal privacy laws, administrative rules, federal regulations, and case law pertaining to privacy information to ensure that Department policies and procedures reflect current law and best practices; interpret and revise policies, procedures, forms, and training materials as needed.
  • Consult with the OIG on privacy-related reviews, inspections, audits, or evaluations.
  • Other duties as assigned.

5% - Personal Development
  • Interact with other staff and clients in a professional manner to maintain a positive working environment.
  • Participate in agency/state task groups and professional organizations to maintain currency in the field, contribute to organizational initiatives and network with other professionals in the information privacy industry.
  • Keep current with data protection and privacy information and issues through reading trade publications, attending conferences, seminars and workshops to increase knowledge in privacy trends and issues, and other applicable skills such as negotiation, communication, conflict resolution, planning, project management, leadership and supervision.
  • Participate in personal development and training programs to maintain a high level of knowledge related to government privacy and confidentiality programs, data governance and management, and program and policy development

Knowledge/Skills/Abilities:
  • Extensive knowledge of the principles and practices of privacy and confidentiality laws and the ability to apply them in a human service setting.
  • Knowledge of fair information practices and other best practices relating to privacy including relevant national and international standards and conventions.
  • Knowledge of federal and state laws and guidelines that protect employee and customer information and privacy.
  • General knowledge of information technology.
  • Knowledge of security technology and practices.
  • Leadership skills in decision making, problem solving and interpersonal relations.
  • Ability to communicate orally and in writing effectively with all levels of management, staff, and partners.
  • Extensive knowledge of program planning principles.
  • Ability to make complex independent judgments and decisions
  • Knowledge of adult training methods.
