Paralegal to work with MVA clients to pay Medicare lien from settlement:
1. 3-way teleconference with client and CMS:
a. report the pending liability claim by creating an account and reporting it on the Medicare Secondary Payer Recovery Portal (MSPRP)
b. talk to the Benefits Coordination & Recovery Center (BCRC)
2. file forms:
a. file Medicare request for conditional payments ledger
b. file request for final demand, citing estimated settlement amount
3. have client
a. give PI lawyer the conditional payments ledger, calculating total medical special damages
b. authorize lawyer to disburse Medicare final demand from client's 2/3 accident proceeds.
4. negotiate with client your flat fee payable 1/2 from client's 2/3 proceeds and 1/2 from lawyers 1/3 fee.
