These responsibilities are divided into two functional sections: Compliance Monitoring and Enforcement.The Enforcement Section implements the Division’s enforcement program by reviewing noncompliance determinations referred for enforcement from the Compliance and Enforcement Program, Oil and Gas Program, Climate Program, Mobile Sources Program, and the Colorado Energy Office, initiating enforcement actions, and negotiating/resolving enforcement actions with regulated entities. The Enforcement Section is also responsible for evaluating submissions made to the Division under the Colorado Environmental Audit Privilege and Immunity Law.What you will be doingThis Environmental Protection Specialist IV position exists to support the overall management and leadership of the Enforcement Section within the Compliance & Enforcement Program. Specifically, this position serves as the first line supervisor for part of the enforcement staff in the Enforcement Section, assigning and coordinating enforcement activities for several (five (5)) full time Environmental Protection Specialists. This position assigns tasks, monitors progress and work flow, checks the product for timeliness and correctness or soundness, establishes work standards, schedules work, including signing leave requests and approving work hours, and provides input into the Compliance and Enforcement Program Manager’s and Enforcement Section Manager’s actions. The position is also involved in planning and evaluating performance, including issuing corrective actions, resolving informal grievances and initiating disciplinary actions. Supervisor starts, performs, and/or completes the hiring process, interviews applicants, and recommends hire, promotion or transfer.In addition to typical supervisory duties, this position also has other responsibilities, such as evaluating the effectiveness of the policies and procedures of the work unit and recommending changes in them to the Compliance & Enforcement Program Manager and Enforcement Section Manager, and quality assuring enforcement documents for their direct reports to ensure appropriateness.Job Duties:Unit Supervisor
Plan, prioritize, and assign workload, and analyze and monitor workflow and progress to ensure the quality and quantity of work meets standards, deadlines for deliverables, and program goals and objectives.
Establish work schedules, review and approve work time and absences using the automated system.
Identify training and developmental needs, and provide training to develop skills.
Provide feedback and coaching; write, review, and sign performance plans; evaluate and sign performance evaluations.
Resolve employee performance problems and issues, disputes, and informal (Step 1) grievances; issue corrective actions and initiate discipline as needed.
Write and review position descriptions, recommend promotions or demotions, changes in pay, and sign personnel action forms.
Initiate the hiring process, provide subject matter expertise to OHR during the comparative analysis process, interview applicants, and hire employees after consultation with the second-level appointing authority.
Maintain up-to-date knowledge of Department and Statewide policies and procedures.
Enforcement Oversight & Support
Oversees the preparation of enforcement documents, including Compliance Advisories, Notices of Violation, Compliance Orders on Consent, Compliance Orders, Cease and Desist Orders, and surrounding written communications
Tracks and monitors enforcement deadlines, such as statute of limitations, high priority violations, etc. to ensure the Division initiates enforcement actions, develops case development and resolution timelines when required, and resolves enforcement actions within applicable deadlines
Engage with the Attorney General’s Office, when appropriate, to secure legal advice
Calculates administrative penalties, consistent with applicable statutes and procedures, for cases this position is overseeing. Elicits and considers feedback on the proposed penalty from members of the case team, and seeks review and approval from the Enforcement Section Manager and Compliance and Enforcement Program Manager as appropriate.
Assist the Enforcement Section Manager and/or Compliance and Enforcement Program Manager in negotiating with regulated entities regarding alleged violations, proposed penalties, adherence to compliance requirements and other matters related to the resolution of an enforcement action
Contributes to the Enforcement Section’s tracking of self-disclosures submitted under Colorado’s environmental audit law, assuring an appropriate and timely response is sent to the submitting company, and other statutory requirements are otherwise satisfied
Identifies and recommends opportunities for other CDPHE and/or Division Programs to work collaboratively and effectively with industry sectors, associations and organizations to improve compliance and enforcement outcomes
Identifies and recommends needed regulatory changes for the enforcement process, permitting programs, etc. to Enforcement Section Manager, Compliance and Enforcement Program Manager, or other Division Program Managers
Provides policy advice, regulatory analysis and interpretive assistance to Program and Division management and other division staff on the application and implementation of federal and state air quality laws and regulations
Program Support
Assists the Compliance & Enforcement Program Manager and/or Enforcement Section Manager in developing and/or reviewing technical procedure memos concerning various aspects of compliance and enforcement activities.
Reviews and evaluates the effectiveness of the policies and procedures of this unit and makes recommendations to the Compliance & Enforcement Program Manager and/or Enforcement Section Manager for improvements and problem resolution
Contributes to the development and implementation of Division strategies for increasing compliance for stationary sources and other sources under the Enforcement Section’s purview
Assists in the development and implementation of program strategies for improving enforcement outcomes in Disproportionately Impacted Communities

Juris doctor degree from an accredited law school
Experience interpreting statutes and regulations
Experience ensuring compliance with and/or enforcing environmental regulations
Strong verbal and written communication skills
Ability to identify the strengths and weaknesses of alternative solutions, conclusions, or approaches to problems
Exceptional attention to detail
Excellent analytical and organizational skills
CONDITIONS OF EMPLOYMENT

Travel 1-2 times per year for conferences, trainings stakeholder meetings, ravel may involve meeting at locations that are some distance from Denver ( around the state and other locations within the United States) or may involve multi-day activities necessitating overnight stays
